Email is the fastest route. Notices sent anywhere else may take longer to reach the right person.
What a notice has to contain
The law sets out what a takedown notice must include. A notice missing any of these may not count:
1. Your signature, physical or electronic, as the owner of the right being infringed or someone authorised to act for them.
2. Identification of the work you say has been infringed. If several works are involved, a representative list is enough.
3. Identification of the material you want removed, described well enough that we can actually find it. A link, a screenshot, the username and the week it appeared in.
4. How to reach you: address, telephone number, and an email address if you have one.
5. A statement that you believe in good faith that the use is not authorised by the copyright owner, its agent, or the law.
6. A statement that the information in your notice is accurate, and, under penalty of perjury, that you are authorised to act for the owner of the right.
What happens next
Valid notices are acted on quickly. The material comes down, the person who posted it is told what was removed and why, and they are pointed at the counter-notice route below.
Content that has been removed stops being served to everyone, including the person who posted it.
If you think we got it wrong
If your content was removed and you believe that was a mistake or a misidentification, you can send a counter-notice to the same address. The law says it must contain:
1. Your signature, physical or electronic.
2. Identification of what was removed and where it was before it came down.
3. A statement, under penalty of perjury, that you believe in good faith it was removed as a result of mistake or misidentification.
4. Your name, address and telephone number, a statement that you consent to the jurisdiction of the federal district court for the district your address is in (or, if you are outside the United States, any district where Sunday7 may be found), and that you will accept service of process from the person who sent the original notice.
Once a valid counter-notice arrives it is forwarded to whoever sent the notice. If they do not file a court action, the material goes back up in ten to fourteen business days.
Repeat infringers
Accounts that repeatedly infringe copyright are terminated: an account that has content removed after three valid copyright notices in any twelve months, not successfully countered, is closed.
